Synopsis

There were two types of testimony in the Ottoman court: One was the eyewitnesses of the event, in the sense we understand and use today, that is, the witnesses of the parties. The other ones were the witnesses of the court, also known as shuhudu'l hal. Who were this second group of witnesses? What were their functions? Among the Ottoman Courts whose number increased in the late Ottoman period, the jurisdiction of the Sharia Court was largely limited to private law, but considering that they were the only judicial authority of the classical period and that the principle of a single judge was valid in this single judicial authority, this single judge may have a role in accounting for his work. Did he need reassurance? Beyond being a judge, this single judge had many duties as the head of the Ottoman judicial-administrative organization, and doing these made him a very active person in society, visible and, of course, a person whose actions were taken into consideration. Did this person perhaps want many influential people in the city to share in his work, at least while being held accountable? The subject of this research is the subject of this research, who constituted these people, called suhûdü'l-hâl or trial witnesses, in the Ottoman Court records, and what were the factors that influenced them in the cases. Work XX. It searches for answers to these questions using the interpretation and analysis of the documents in the Urfa Şer'îyye Registry No. 215/1, which contains information from the 19th century.
